The Chairman presented a planning commission resolution that would extend the county's 3-foot flood-elevation standard used for A zones to AE zones.
A commissioner asked whether planning and zoning could enforce a requirement that had not yet been passed; Chairman responded that nothing is enforceable until adopted. "Nothing is enforceable till it's passed," the Chairman said, and commissioners agreed notification to affected applicants would be prudent.
Commissioner Harris explained practical implications for property owners and lenders, noting that banks and flood insurance requirements are identified during loan closings and that property owners can pursue a "letter of map revision" (or amendment) to remove a parcel from a flood designation. "Then they can get what is called a letter of map revision or letter of map amendment," Commissioner Harris said.
The committee discussed grandfathering for projects already underway and confirmed the rule would not apply retroactively. Chairman said the change "won't start until December" and that any applications submitted after that date would be subject to the new standard.
The committee moved to approve the resolution on the floor (mover and seconder not recorded in the transcript). The transcript records discussion and a motion/second but does not contain a recorded vote tally or formal adoption details.
