Developer says intermunicipal agreement needed for water and sewer at 1205 Warburton; board requests site visit

Mark Blanchard, counsel for the applicant, told the zoning board on Oct. 15 that a condominium assemblage affecting Yonkers and the village of Hastings will require an intermunicipal agreement (IMA) to secure water and sanitary service before building permits can issue.
Blanchard said the applicant obtained a "will‑serve" letter indicating Yonkers sanitary capacity and that the project design includes measures to control stormwater and mitigate environmental impacts. He noted that after discussions with Westchester County and Hastings the project now includes four affordable units as part of the broader assemblage.
Blanchard also said the city’s planning commissioner signaled the IMA should be resolved sooner rather than later, because the building department will not issue permits until utilities and any legislative conditions are addressed. The applicant asked for a site visit and the board agreed to schedule one and to request outstanding traffic and engineering materials from the applicant.
The board emphasized that the IMA is a legislative agreement between Yonkers and Hastings and not a zoning board action; any final approvals that depend on that agreement will follow the intermunicipal process and department review.
