The Waukesha City Finance Committee on Nov. 11 recommended payment of a $661.50 property-damage claim filed by Rosibel Salinas after staff investigators found the tree that caused the damage had been identified as diseased and scheduled for removal but had not yet been removed.
Bridal, the city staff member who reviewed the claim, told the committee that she had spoken with the city forester, Aaron Lehnert, and that the tree "was a tree that was known to be a disease. It was marked for removal, but we just didn't get around to removing it before this incident happened." Based on that finding, Bridal said she was recommending allowance of the claim for $661.50.
A committee member asked whether paint scratches referenced in the claim were covered; Bridal said that when the city pays a claim the claimant signs a receipt and release and that the release states this is full and final payment for the claimed items. A committee member also asked whether Parks, Recreation and Forestry had delayed removal; Bridal said crews were dealing with a backlog and scheduling prevented earlier removal.
A committee member moved to approve the claim and recommend payment to counsel; the motion passed unanimously, 4-0.
