He described the PCOs as “0 cost PCOs” that utilize dollars the contractor already set aside in the GMP. Commissioner Stacy moved to approve the change order; the court approved it 5–0.
Court discussion focused on schedule impacts and clarifying what owner allowances require explicit change orders. Nico said the project remains under budget but behind schedule due to permitting and owner‑driven requests; RTUs and furniture fit‑tests were also discussed as near‑term items.
