Eau Claire council approves Sherman Creek Landing subdivision agreement and sidewalk deferral with developer payback

The City Council on Nov. 11 approved a subdivision infrastructure agreement (SIA) with Black Creek Builders LLC for Sherman Creek Landing and adopted staff—s proposed amendment to defer certain sidewalk construction along Dorit Road until the city—s planned capital improvement project.
City Engineer/Director Leah Ness explained the SIA covers street, utilities, stormwater and right-of-way items and said the sidewalk deferral is appropriate given coordination with a city engineering project. The amendment requires the developer to pay 100% of associated sidewalk costs, billed back through the SIA and review fees, and states the developer—s letter of credit shall not be released until actual sidewalk installation costs have been paid.
Council discussed tree-protection ordinance applicability (the development predated the new tree code) and agreed the deferral language protects city design control and ensures the developer remains financially responsible. The amendment and the overall resolution passed unanimously.
