At the Oct. 8 meeting the Anaheim Elementary School District board reported it had authorized filing legal action against contractor Balfour Beatty following a closed-session discussion (SEG 176–179). President Juan Gabriel Alvarez announced the action on returning to open session; the transcript reported the result as "on a vote of 5 2 0" (SEG 176) which the district said it would document in the official minutes.
Earlier in the meeting the board moved to adjourn to closed session (motion by Alvarez, SEG 091) and approved the agenda and consent calendar by recorded votes. During the action calendar the superintendent referenced Education Code 35120(c) in describing the statutory basis for board-member remuneration for missed meetings and asked the board to ratify past absences when they meet the listed authorized bases (district service, illness, jury duty, hardship) (SEG 3484–3493).
The board considered and approved several resolutions ratifying compensation for the past absences of trustees; by procedure the board members discussed each resolution and the trustee whose absence was being ratified abstained from the vote. Examples recorded in the transcript include: a resolution addressing trustee Ryan Ruelas’ absences (motion carried with an abstention for the trustee, SEG 3591–3610) and similar ratifications for trustees Juan G. District staff said they will record the closed-session action and provide the official minutes with vote tallies and supporting documentation; the superintendent noted one trustee (Ruelas) identified one absence that did not qualify and that district staff would resolve reimbursement for that date (SEG 3520–3524).
Next steps: the district will finalize and publish the official minutes and any supporting memos for the closed-session legal action and the ratified resolutions.
