Planning commission recommends approval for Lincoln Investment Properties’ automotive dealer at 5959 Northwest 39th

Warr Acres planning commissioners voted Tuesday to recommend approval of a use-subject-to-review application from Lincoln Investment Properties to operate an automotive sales business at 5959 Northwest 39th Street.

City staff member Dakota explained the proposal mirrors a prior approval on the west side of the lot and said, "Used auto sales locations are generally allowed in C5." Dakota told the commission the surrounding area is primarily commercial and that apartments sit to the north, and staff recommended two items for compliance before opening: "provide 12 marked spaces in order to meet the parking requirements for the business" and limit the use of the auto bays to detailing and indoor storage rather than repairs.

Commissioners pressed the applicant and staff on permitted activities. Staff clarified that general automotive repair is a separate use and "if they wanted to add it, then they would have to come back and ask for that use." The applicant confirmed the intent is sales, detailing and indoor storage for inclement weather and not auto body or repair work.

There was no public comment during the hearing. After discussion, Commissioner S2 moved to recommend approval and the motion was seconded; commissioners Plumtree, Schiff, Corey, Davis, Clifton and Johnson each voted yes and the motion passed. City staff noted a certificate of occupancy inspection will verify compliance with the parking-striping requirement and other ordinance standards.

The commission will forward its recommendation to the Warr Acres City Council, which meets next Tuesday at 6 p.m.; staff said an applicant representative should attend the council meeting to answer any council questions.
