City advances one sidewalk variance to council, denies or moves another after debate on ADA and precedent

Two sidewalk variance requests were discussed in sequential agenda items.

PW11225-07 (Bellevue Drive): The applicant requested a variance to waive installing sidewalk along Bellevue Drive per Rapid City Municipal Code 12.08.06. Neighbor testimony emphasized that sidewalks in surrounding blocks are continuous and that the missing segment (vacant since 1951) should be completed to connect the neighborhood; speakers urged the city find ways to make required sidewalks more affordable (procurement discounts or alternative funding) so the cost does not block development. After discussion the council recorded a motion 'to deny' the variance and the chair announced the motion passed by voice vote.

Renner & Associates on behalf of Black Hills Outdoors (1st Street): Staff said a sidewalk had existed and was removed when a building was demolished and noted absence of curb-and-gutter could complicate immediate construction; staff warned that granting a variance as part of a building permit could set precedent and recommended any variance include a requirement that if the city later constructs a street improvement, the property owner pay their fair share. Council discussed whether adjacent concrete or parking pads might substitute for ADA-compliant pedestrian surfaces; staff responded such surfaces would not meet ADA unless placed in right-of-way with ADA ramps. The council chose to forward this item to the city council 'without recommendation' to allow further study and possible stipulations.
