Pat, highway department staff, told the Committee the draft letter is intended to put the consultant on notice and to preserve the county’s ability to seek reimbursement for recoverable costs. He said the project has generated change orders 1 through 6 totaling about $27,000 on an approximately $800,000 bridge; examples cited included incorrect rebar lengths, miscalculated concrete quantities for abutments and items that did not appear on the plans such as beam guard removal.
The motion to prepare and forward the letter was made and seconded and passed by voice vote. Pat clarified that preparing the letter does not obligate the county to pursue a formal claim and that DOT oversight may identify recoverable costs; he said staff could not yet estimate a recoverable dollar amount while the project remains in progress.
Committee members asked whether county employee time would be recoverable; Pat said county staff had not logged extra time on the issue and that potential recoveries would likely be through DOT review. Pat warned the project remains ongoing, and decisions about formal recovery of costs would follow further analysis.
The Committee’s action directs staff to coordinate with DOT and finalize the E&O letter for the consultant; no payment or further commitment was made at the meeting.
