Magistrate orders Island Time Marina lot to secure permits or face $250/day fine

Magistrate Lonnie Groot found that Island Time Marina and property owner Coconut Cove Yacht Club violated Cocoa Beach codes by constructing and maintaining an unpermitted parking lot at 398 West Cocoa Beach Causeway and ordered the defendants to bring the property into compliance by Nov. 20, 2025.

Daniel Crawford of city code enforcement presented photographs and a timeline showing work beginning Jan. 9, 2023, and continuing through April 15, 2025, that included paving, accessory structures and on‑site debris. Crawford told the magistrate that permits had been applied for but remained incomplete and that some dilapidated boats, trailers and building materials remained on the lot.

"We respectfully request that you find the respondent in violation and give the respondent until November 20 to bring the property into compliance," Crawford said in court. The city asked that a $250 per‑day fine be instituted if violations continued beyond the compliance date.

Groot admitted the city's PowerPoint into evidence, reviewed the photographs and ruled the conditions constituted violations as charged. "If they do not come into compliance with each and every code, then a fine of $250 per day will be set and run for each day of noncompliance after 11/20/2025," the magistrate said.

Crawford said the building permit and site plan were awaiting zoning, engineering, stormwater and administrative approvals; the city will confirm compliance after inspections. A written order will be issued and distributed to parties in the coming week.

The magistrate’s order does not change the sequence of permitting steps the city requires; it sets the compliance deadline and the daily fine to deter continued noncompliance.
