Delray Beach code board orders removals, fines and repair deadlines for swale markers, vehicles and outside storage

The Delray Beach Code Enforcement Board on Nov. 5 ordered property owners at four addresses to correct code violations or face daily fines.
At 310 Southeast 5th Street (Case 25000198), Code Enforcement Officer Latoya Thompson told the board that a citizen complaint and follow-up reinspections showed cinder blocks, a metal rod and rope used as a marker placed within the public right-of-way. Thompson said the items exceed the size allowed under Code section 100.1(e). The city recommended removal within seven days or a $50-per-day fine until compliance. A motion finding a violation and imposing the seven-day correction period with daily fines passed unanimously.
A resident who spoke during public comment said she had placed temporary ropes and blocks because vehicles repeatedly parked on the swale and because she said the city had not installed requested ‘no parking’ signs. The resident told the board she had sought signage since June 2023 and described safety and maintenance concerns.
In Case 25000206 (206 Southwest 11th Avenue), Code Enforcement Officer Reggie Williams presented nine photographs documenting a black Toyota Yaris with flat front tires stored on the property. The city recommended 10 days for the owner to remove or repair the vehicle or face a $50-per-day fine. The board voted to find a violation and adopted the 10-day correction order and fines.
Case 25000235 (544 Fern Lane) involved a vehicle parked over a landscape area in violation of subsection 4.6.0.16(e)(3). Officer Shantel Jean Baptiste introduced photos and testified that a prior warning and reinspection showed the vehicle remained off the driveway. The board ordered correction within seven days or a $50-per-day fine.
Case 25000283 (567 Lawrence Road) addressed outside storage of building materials and trash in violation of code section 4.6.0.11. After the city entered eight photographs into evidence, it recommended seven days to remove the materials or a $100-per-day fine until the property is cleared. The board adopted an order consistent with that recommendation.
All four orders require the respondent to notify the code enforcement officer when the property is brought into compliance; the board directed staff to report any noncompliance for further action, including liens assessed against the properties.
The board emphasized that its role is to apply the facts on the record to the code, while also noting members’ empathy for residents who raised concerns about enforcement consistency and neighborhood conditions. The meeting adjourned after additional agenda items.
