Garden City’s council completed the second reading of Ordinance 10-58-25 on Oct. 27, marking a step toward prohibiting motorized watercraft on the Boise River within city limits.
Legal counsel told the council the draft ordinance is intended to create a uniform rule coordinated with Ada County and the Boise City Attorney’s Office. Counsel recommended treating the prohibition as an infraction punishable by a $100 fine plus court costs, rather than a misdemeanor. "I think it is, more better fitted as an infraction myself, punishable by a $100 fine plus court costs," counsel said, while also noting that existing Idaho Code misdemeanors cover reckless operation and property damage in other circumstances.
Council members asked for clarification about enforcement in specific scenarios. Council member Adams asked whether launching a motorized craft from a city park or the greenbelt that causes damage would be addressed under the ordinance; counsel said the outcome would depend on the facts and that property damage could still meet elements of an existing misdemeanor under Idaho Code.
Council President raised concerns that some local HOAs launch motorized boats into private ponds that are hydrologically connected to the Boise River for routine maintenance. Counsel confirmed carve-outs in the draft ordinance already cover the Ada County sheriff, Garden City police, Boise police, local fire department and designated representatives, and would not extend to typical HOA maintenance uses or park system staff unless specifically listed.
The council moved to read Ordinance 10-58-25 by title only for its second reading and approved the reading and summary by roll call. The action moves the ordinance forward with the effective date provided in the ordinance text.
