Commission approves Logan Minor Subdivision final plat; conditions noted for fire protection and water notice

County planning staff presented the Logan Minor Subdivision final plat and related documents and recommended approval after confirming required items had been submitted or satisfied. The staff presentation listed the completed items required for final plat approval: postal-service mailbox-letter, a fire-protection plan signed by the Broadwater County Rural Fire District chief (who requested $1,000 per lot), a signed noxious-weed management plan, covenants and a right-to-farm statement, proof of current taxes and proof of ownership.

Planning staff and the county’s planning attorney explained that because this minor subdivision involves use of an exempt well, the property owner or future lot buyer remains subject to Montana Department of Natural Resources & Conservation (DNRC) procedures. Staff noted that under recent statutory changes, new notices of intent to appropriate water and related DNRC review procedures provide additional protection for future lot owners; DNRC notice of intent does not guarantee a water right but alerts the agency to a proposed subdivision.

A commissioner moved to approve the final plat; the motion was seconded and commissioners approved the plat by voice vote. Staff will place the final paperwork and the documents requiring signatures on the commissioners’ signing table so signatures can be executed.

Ending: County staff will forward final documents to the commissioners for signature and the landowner must coordinate the $1,000 fire-protection payment and any DNRC steps required for water rights.
