The Cheektowaga Environmental Advisory Committee on Oct. 29 voted to table a proposal for a new 155‑foot monopine telecommunications tower at 94 Lawson so the applicant can obtain state concurrence on an existing wetland delineation.
Brenda Lewis, an applicant contact on the call, and engineer Mike Montalto discussed site location behind a church parking lot. County planning flagged federally regulated wetlands near the site and requested a jurisdictional determination or state concurrence. Montalto told the committee a wetland delineation had been completed and that recent regulatory changes mean DEC now handles federal wetland jurisdictional determinations in New York. He said the project would likely require a general permit filing because the proposed disturbance in the DEC adjacent area exceeds the expedited threshold, and that the team intends to seek concurrence on delineation boundaries rather than extend a lengthy jurisdictional process.
An EAC member noted the committee needed state input to confirm boundaries and any mitigation or permit conditions. The committee then made and approved a motion to table the application pending DEC concurrence on the delineation and guidance on permit sequencing.
Committee members asked the applicant to provide the delineation maps and to coordinate with the DEC regional office and town staff about mitigation measures and any required tree survey, replacement fees and access road surfacing details.
