The Cheektowaga Environmental Advisory Committee on Oct. 29 recommended a negative declaration for a Verizon collocation on the existing Town Hall tower, finding the request largely procedural and subject to federal eligible‑facilities rules.
Jared, the applicant representative, described a collocation that would attach 12 antennas and six remote radio heads to the existing tower and replace equipment at the base within the current compound. He said there is no net increase to the compound footprint and that equipment cabinets and a generator would be sited inside the existing fenced area.
County planning and NYSDOT provided no recommendation on the project. Committee discussion noted the federal “eligible facilities” rules and the Middle Class Tax Relief Act (2012) that limit local discretion over collocation of wireless equipment. As one participant summarized, “there really isn't any discretion given because it's an eligible facilities request under federal law anyway.”
The committee moved and approved a recommendation for a negative declaration. Members noted any required General Municipal Law referrals or other administrative referrals would proceed through the town’s standard permitting process.
The project team said they would provide necessary plan notes and coordinate with town staff on any ministerial requirements during the site filing and permitting stages.
