EAC asks Valley Tire applicant to respond to DEC comments, rescinds prior EAF for further review

The Cheektowaga Environmental Advisory Committee on Oct. 29 moved to rescind the previously issued Environmental Assessment Form (EAF) for Valley Tire’s site plan at 3419 Broadway and directed the applicant to submit a formal response to recent DEC comments.
Committee members said comments from the New York State Department of Environmental Conservation and Erie County Department of Environment and Planning raised several items that need clarification before the EAF determination can proceed. The issues noted in the DEC letter included a stormwater pollution prevention plan (SWPPP), coordination with the Office of Parks, Recreation and Historic Preservation for identification of culturally sensitive resources, potential federal wetland impacts and the need for a downstream sewer capacity analysis.
An EAC member summarized the four main concerns: “Item 1 talks about a SWIP. Item 2 talks about the need for clearing of our electrical sensitivity items on-site, with the Office of Parks, Recreation, and Historic Preservation... It also talks about the need for partial jurisdictional determination, potential wetland clearing, presence on-site... and a detailed downstream sewer capacity analysis under item 4.”
The committee’s action was procedural: members voted to rescind the earlier EAF determination and to request that the applicant provide documentation addressing DEC’s recommendations. The applicant and town staff agreed the engineering reviewers will examine materials when they are submitted.
EAC members also discussed that some DEC items may be addressed through follow‑up filings (wetland delineation and downstream wastewater capacity), and encouraged the applicant to coordinate with Erie County water and sewer staff and DEC for clarification on which items are needed prior to final approvals.
The motion to rescind the EAF and request a formal written response to DEC comments passed by voice vote.
