Grand County commissioners approved an internal road vacation for Red Hawk Ranch on Oct. 28 to allow the developer to provide utility service under new utility-company policies that require gas lines to be located in private easements rather than in public rights of way.
Community Development staff said the roads had been dedicated as public rights of way during preliminary platting, but Xcel Energy’s revised policy would not place a gas main within a public roadway dedicated to the county. Vacation of the internal roads will convert the internal rights-of-way to private status; the developer will deed the vacated roads to the planned homeowners association (HOA) and the HOA will be responsible for maintenance.
Director Chris Manguso told the board the county has not accepted new public roads for maintenance for many years and that the internal roads were not intended for county maintenance. Staff recommended approval; the Planning Commission had recommended the same and no public objections were recorded during the notice period.
Commissioners approved the internal-road vacation with condition language specifying vesting and deed transfer to the HOA when the property vests and the developer deeds the roads to the HOA.
