Staff said the contract now includes commercial general liability coverage at $2,000,000 per occurrence and $5,000,000 aggregate and an excess umbrella provision of $1,000,000 in the contract. Staff compared that to the higher limits in the authority's Covanta and TRT agreements, which have a $10,000,000 umbrella for those contracts. Staff also confirmed the contract retains a contract CPI adjustment that is capped at 5% for a given year; a proposed rollover mechanism for exceeding the 5% cap was not accepted.
