The Clay County Board of County Commissioners on Oct. 28 approved a conditional lien settlement for a Sweat Road property with active code‑enforcement violations, subject to specific conditions.
Staff reported an accruing $25‑per‑day fine beginning Aug. 16, 2024; by Oct. 28 the total lien (including staff costs) was $12,670. A prospective buyer told the board he had negotiated a purchase for $100,000 and offered to pay required taxes and fines if the county would agree to release the lien on that parcel after the property was brought into compliance. Staff confirmed cross‑attachment of liens to multiple properties the owner holds; a release for this parcel would not remove liens from the owner’s other properties.
After extended discussion the board approved a motion with these conditions: the property must be brought into compliance (mobile homes removed, grass cut and code violations corrected) within 60 days; the buyer or seller must pay the lien amount of $12,670 at closing; and the mobile homes removed from this property may not be relocated to any of the owner’s other properties listed as having liens. If the property is not brought into compliance within the 60‑day period, fines resume and the county retains the full lien. The motion passed with a majority of commissioners voting in favor.
The action releases the lien on the Sweat Road parcel only after compliance and payment are confirmed; the owner’s other properties retain their liens until separately addressed.
