Committee defers PREA-designated claim to December, plans executive-session review

Because PREA complaints often include medical and investigative records that are actively protected by federal law, the committee recorded a motion to carry the item to its Dec. 2 meeting and to plan an executive session so the committee can consider confidential evidence and witness testimony without public disclosure. KDOC committed to deliver an internal report and a recommendation to the committee before that date.
The committee’s decision to defer reflects a balance between a claimant’s request for hearing and the legal limitations on public discussion of PREA investigations. The committee will determine whether executive session is legally appropriate before receiving further details.
