Council approves ARPA stormwater supplement and $1.39M culvert contract; donates stage and completes land-acquisition settlements

The Indian Trail Town Council approved several infrastructure and administrative items at its Oct. 30 meeting, including ARPA-funded stormwater work, a culvert replacement contract, a surplus-equipment donation and post–closed-session land-acquisition settlements.
Public works staff reported that the ARPA stormwater design and construction bundle is funded primarily through the American Rescue Plan Act and that additional on-site engineering and inspection time was needed for the Bow Brook and Pioneer Lane culvert replacements. Todd Hunsinger said the original contract budget included $43,004.44 for construction oversight and asked the council to approve supplemental Agreement No. 1 for $37,728 "for additional construction oversight," citing a need for more frequent consultant presence during critical work.
Council approved the supplemental agreement by unanimous voice vote.
On the related construction contract, the town received five bids for the Bow Brook and Pioneer Lane culvert replacement. Staff reported an engineer's estimate of $1,800,000; the lowest responsive bid of $1,385,511.60 came from Birdsall Excavation Construction LLC. Council voted unanimously to award the notice of award to Birdsall Excavation Construction LLC for $1,385,511.60.
Council also approved a donation agreement to transfer the town's portable stage to the Lante Foundation (confirmed as a 501(c)(3)) after staff review and legal sign-off. The donation was approved by unanimous vote.
The meeting went into closed session under attorney-client privilege for litigation and acquisition matters. After returning to open session, council voted unanimously to approve two post–closed-session settlement/acquisition payments to Charles and Betty Stein: an additional $19,300 for a partial right-of-way acquisition (case 24CV005285-890) and an additional $29,050 for Parcel 6 acquisition with agreed improvements to the unimproved parking lot on that parcel (case 24CV005293-890). Council additionally approved naming the fourth leg of the roundabout EB-5931 as "Stein Street" in recognition of Stein family contributions.
The consent agenda and other routine items were approved earlier in the meeting by unanimous vote.
No council member recorded a dissent on the actions taken in open session.
