Clay and Becker Counties adopt amended Partnership for Health documents; local board to assume delegated public‑health duties

The Clay County Board of Commissioners on Oct. 28 approved three documents to reconstitute the Partnership for Health Community Health Board as a two‑county entity with Becker County: an amended joint powers agreement, a delegation agreement and bylaws.

Rory (public health staff) presented the changes and said the amended joint powers agreement narrows the partnership from four counties to Clay and Becker while preserving statutory duties. The joint powers agreement lists core public‑health functions (as reflected in statute) including assuring adequate local public‑health infrastructure, preventing spread of infectious disease, protecting against environmental health hazards, emergency preparedness and mobilizing community resources. The agreement also addresses governance: two county commissioners (one year terms) from each partner county; an at‑large community member with a three‑year rotating term; indemnification; and a one‑year notice for withdrawal.

The delegation agreement delegates operational duties to the local public‑health departments effective Jan. 1, including vaccine distribution in accordance with Minnesota Department of Health policy, communicable‑disease reporting, enforcement of public‑health nuisance laws, and fiscal reporting and auditing responsibilities. Rory and county legal staff said the Minnesota Department of Health reviewed and participated in the process and that MDH oversight and timelines informed the documents.

The board approved each document in separate motions: joint powers agreement, delegation agreement and bylaws. Commissioner Ebinger moved to approve the joint powers agreement; Commissioner Bair seconded. The board similarly approved the delegation agreement and bylaws by voice vote.
