Jeff Simmons of Bax Engineering presented the project, describing two eight-unit, two-story townhome buildings with common-ground open space and a detention basin to the north. Staff reported unpermitted fill on parts of the property and that legal cross-access to the rear of the parcel has not yet been recorded; the applicant is working with the owner of an adjacent property (5 Star Electric) on an access easement.
Commissioners and public speakers emphasized concerns about the unpermitted fill and potential impacts on neighboring yards. The commission amended staff language to require that a geotechnical study "shall" be completed and approved by city staff before building permits are issued; the mayor additionally requested that the geotechnical submission include an analysis for hazardous materials in the fill. The commission also required that recorded easements and access arrangements be completed before construction permits proceed.
The commission recommended rezoning to the City Council and approved the site plan with the geotechnical and easement conditions. The transcript does not include a roll-call tally for the votes; staff said the rezoning recommendation will be heard by City Council at the next council meeting.
