Rutherford County Schools policy panel requires residency at time of application for choice schools

The Rutherford County Schools Policy Committee voted to require that applicants to choice schools establish primary domicile in Rutherford County at the time they submit their application.
Monica Ridley, general counsel for Rutherford County Schools, introduced the change to policy 1.703 during the committee's meeting, saying the amendment would "add language that the requirement of primary domicile to be in Rutherford County at the time of the application to our choice schools." The committee also considered a related change to policy 6.204 to exempt choice schools from early-admission contracts used for regular enrollment.
The change follows staff and board concerns that applicants have been applying while living outside the county and moving in only after receiving admission, a pattern Jimmy Sullivan, director of schools, described as taking "seats away from people who are taxpayers and community members and citizens." Sullivan urged the committee to require proof of residency at application rather than at the start of school.
Committee members asked whether a lease or a purchase contract would satisfy the requirement; staff and members confirmed that a valid lease or contract would be accepted when the tax card is not in the applicant's name. The committee discussed and rejected using post office boxes or business addresses as proof of domicile.
The committee moved and approved the policy changes by voice vote; the motions were approved without a recorded roll-call tally. The committee also clarified the regular choice-school application window, noted during discussion as December 1–January 31, and confirmed that moving into the county during a semester generally does not permit immediate enrollment in a choice school because seats and waiting lists are handled under different timelines.
The committee instructed staff to incorporate the language changes into the formal policy documents for board consideration and implementation.
