Rezoning request for 7104 Hall Road fails after commissioners debate lot widths and density

Applicant representative Tim Mangrum presented a concept showing six lots; he said site shape and required right‑of‑way dedication reduced available area and affected frontage. Staff described the property as 3.17 acres currently zoned RS‑40, located southwest of Cox Pike and Hall Road. The Fairview Forward 2040 plan classifies the parcel as legacy residential and lists RS‑40 and R‑20 as appropriate districts; RS‑15 is not listed.
Commissioners discussed whether RS‑20 with a variance on lot width could achieve the applicant’s objectives without rezoning to RS‑15. Staff said RS‑15 has a minimum lot width of 75 feet while RS‑20 requires 100‑foot widths; given the property’s frontage it would be difficult to fit the theoretical nine lots RS‑15 might allow. Commissioners expressed reluctance to rezone to a denser district simply to make a particular lot layout work; one commissioner said if five lots is all that practically fits under RS‑20, then five lots is appropriate.
After discussion the motion to recommend approval failed on a 4–5 vote. The applicant may revise the concept, pursue a rezoning with more information, or pursue variances as appropriate.
