On Aug. 12 the Placerville City Council authorized the city manager to negotiate a fee-deferral agreement for designated impact fees for the Middletown apartment complex, a multifamily affordable housing project at 180 Middletown Road.
Planning staff reported that the building permit invoice lists impact fees totaling $1,800,000 for fire, park, traffic and sewer capital charges. Staff cited Senate Bill 937 (2024) as the state law allowing deferral of such fees for affordable housing projects until issuance of a certificate of occupancy, without interest, to support project feasibility. Staff said the deferral can include safeguards such as a lien or financial security if the council desires, and full payment would be due at project completion.
Council discussed whether requiring bonds or letters of credit would provide additional security; staff noted an inherent safeguard because certificates of occupancy would not be issued until fees are paid. After discussion, Councilmember (mover not specified) moved to authorize the city manager to negotiate the agreement as outlined and the council approved the motion by roll call.
Staff told council the deferral would not affect the general fund and the proposed approach is administrative and exempt from CEQA because it does not involve a physical project.
