Town staff briefed the Burns Harbor Redevelopment Commission on the status of Phase 1b agreements, saying the utility company and the National Park Service are both working through contract language that must be reconciled with grant requirements.
Tina (staff) said NIPSCO experienced technical issues sending a revised agreement but had modified its standard language to include a reference that the trail project is state-funded and to acknowledge a requested 25-year right of way term required by the grant. Tina said the revised NIPSCO document will be routed to legal staff for final review and to the commission for approval once received.
On the National Park Service partner design and construction agreement, staff told the commission the NPS template is typically used for 'friends of the park' groups and contains provisions not well suited to municipal projects. The commission, town counsel and the project team reviewed the template and identified clauses to narrow the agreement’s scope to construction activities rather than broader design responsibilities. Staff said they will redline the draft with Porter's attorney and attorney Patton, then return a revised draft to NPS staff for comment and subsequent legal review.
Staff emphasized the project is state- and locally-funded, not federally funded, and said narrowing the agreement is intended to limit unrelated obligations. No final contract was approved at the meeting; staff estimated the revised draft could be available for the next meeting’s packet.
