The Town Council voted to deny a petition for a curb cut at 93 Bayview after hearing that the work was performed without prior permits or engineering review. The council instructed the applicant to work with the Director of Public Works and Community Development, submit a new permit application and remove the unapproved concrete from town land within a short timeframe.
Applicant Sani Nassim told the council he believed permits had been obtained by his contractor and said he recently learned that the curb cut had not been permitted. Director of Public Works (Director Perrell) told the council his recommendation was to deny the current petition because the curb cut had not been reviewed for engineering standards, it had damaged new curb and it reduced public on‑street parking. He advised that the width on town property would need to be reduced and that replacement concrete must include expansion joints and meet town standards.
Council members pressed about timing and enforcement. Director Perrell suggested the applicant be required to resubmit within 30 days and that some of the work on town property would need removal and replacement to restore town curb and maximize neighborhood parking. On a motion to deny and require resubmission and removal of the unapproved concrete, the council voted in favor and set a 30‑day timeline for a revised plan and coordination with town staff.
What’s next: The applicant must work with DPW and Community Development to file a new plan that meets engineering and parking‑offset requirements. The council recorded that, even after denial, the physical driveway remains and will need to be altered or removed to comply with town standards.
