Planning commission adopts 2026 calendar; staff reviews enforcement, appeals, and local projects

The Midvale Planning Commission approved its 2026 meeting schedule, keeping the second and fourth Wednesday meetings and leaving optional dates (May 27 and July 22) on the calendar to be canceled if not needed.

During other business, staff walked commissioners through remaining chapters of planning guidance, focusing on enforcement, appeals and 'takings.' Staff explained the typical enforcement steps (warning, fines, escalating civil fines, potential liens on property after persistent noncompliance, and the criminal track where applicable). They also described the appeals pathway: the appeal authority (an administrative law judge) and then district court for further review. On takings, staff summarized the general legal principle that a government cannot regulate property so severely that the owner is left without any use, or else compensation may be required.

Staff reported that multiple applications the department submitted to the Wasatch Front Regional Council (WFRC) passed an initial screening and will proceed in the funding process. Staff said the development agreement and code change involving the Gardner Company property south of Ivy Drive will be on the City Council agenda next week. Progress on the Port Of Rockwell trail study was described as slower than expected but reaching options that are beginning to crystallize. Staff also noted a recent training on title reports and invited ideas for next-year land-use trainings.

The commission closed its business and adjourned at 6:43 p.m.; one more meeting is scheduled for December.
