Planning commission approves two‑lot East Canyon Retreat subdivision with wellhead‑protection condition

The Morgan County Planning Commission on Nov. 13 approved preliminary and final plat approval for the East Canyon Retreat small subdivision, a two‑lot division of a 10‑acre parcel at 4950 and 4964 South Highway 66 in the Porterville area.

Planning staff told the commission the property is zoned RR‑5 (rural residential, five‑acre minimum) and that a newly located septic leach field and a corresponding septic permit from Weber‑Morgan Health Department must be in place. Staff said its review found the application meets county code minimums and recommended approval.

Applicant Tom Duffy and his son, Chad, were present and answered commissioners’ questions about water and utilities. Duffy said each new residence will have an individual well and that an older surface‑water well is present on an easement but not in use. Commissioners asked that wellhead protection zones be shown on the plat so the required 100‑foot radius does not extend beyond lot boundaries; Duffy agreed to add the circles and to note utility easements before mylar signing.

Member Sessions moved to approve application 25.012 based on staff findings in the staff report dated Nov. 13, 2025, with the additional condition that utility easements and wellhead protection zones be shown on the plat. Member Wilson seconded; the motion carried unanimously.

The approval is conditional on issuance of any required septic permits and on the final plat reflecting the agreed‑upon wellhead protection circles and easement language. The commission noted staff and the county surveyor will coordinate final plat details before recordation.
