The Brazos River Authority board voted to authorize the agency to use the alternative project delivery methods in Texas Government Code chapter 2269 for public‑works construction projects.
Blake Cutler, BRA’s chief planning officer, told the board the change does not eliminate the design‑bid‑build method currently used under Texas Water Code chapter 49 but adds tools such as competitive sealed proposals and progressive design‑build for larger projects like dam, pipeline, and treatment‑plant work. Cutler said alternative delivery can improve early collaboration among owner, designers and contractors, reduce schedule risk and increase cost certainty.
Senior staff counsel Riley Woods reviewed the statutory history and explained that river authorities historically operated under chapter 49 but can opt into 2269; staff said they would continue to use chapter 49 for smaller procurements and apply 2269 selectively for projects where best‑value selection is preferable. Directors asked about the definition of "public works," impacts on staff workload and HUB compliance; staff said the change targets larger projects and that they have discussed compliance with TCEQ and other agencies.
Director Kron moved the resolution authorizing use of chapter 2269 and Director Henderson seconded; the board approved the resolution by roll call.
