Committee clarifies oath, assumption of office and how regular meetings are defined

The Lakeland District policy committee discussed the timing for trustees to assume office and the administration of the oath of office, and examined how the district's practice of calendaring special meetings affects whether a meeting qualifies as "regular" under statute.

Committee members read that trustees are elected for four-year terms beginning Jan. 1 following their election and that "an oath of office shall be administered" at the first meeting after a trustee assumes office. The draft states the oath may be administered by the clerk or by a trustee of the district and that "the oath may not be administered at a special meeting," language committee members reviewed for clarity.

Speaker 3 asked whether "the quorum of 2 is okay" when new trustees are sworn in; Speaker 1 corrected the practice and outlined why attendance and proper swearing-in are necessary before trustees may act. The committee explored whether meetings the district has been calling 'special' but that are calendared and given public notice meet the statutory definition of regular meetings; Speaker 1 said calendared special meetings are effectively regular for purposes such as public comment and counting toward consecutive-meeting absence rules.

Members agreed to rewrite awkward phrasing that currently reads "next following such appointment" to clearer language indicating trustees shall "qualify for and assume office at the next regular meeting of the board of trustees following such appointment." The committee did not take final action; staff will redraft the wording and return it to committee.
