Council declares 6800 N. Lakefront Drive a nuisance; delegates abatement after dumpster-contract dispute

The Warr Acres City Council on Nov. 18 declared a property at 6800 North Lakefront Drive a public nuisance and authorized the code enforcement officer to proceed with abatement at a time of his choosing, after hearing progress reports and a dispute over dumpster sizes and fees.

The property owner had appealed an abatement order; staff and residents reported cleanup progress and presented recent photographs. Code enforcement explained that the property had been subject to prior abatement work and that volunteers and neighbors had helped the cleanup effort. The council discussed options ranging from tabling the appeal to formally declaring a nuisance and delegating abatement authority back to code enforcement.

A key point of contention during the hearing was which dumpster size and contract terms applied when volunteers filled containers for the cleanup. The owner said she signed an application for two dumpsters and submitted the form; staff and council members said the ordinances and standard residential form contemplate a 4-cubic-yard container and that larger 17-yard containers would incur commensurately higher fees. The owner said the contractor delivered larger dumpsters and that confusion existed about who would pay the additional dumping charges; council members noted that the city had previously covered larger dumpsters for certain abatements but that the ordinance-prescribed residential service is the smaller size unless a new contract is executed.

After extended discussion, a councilmember moved to order code enforcement to abate the property at 6800 N. Lakefront Drive and to declare it a nuisance; the motion specified that abatement could occur at a time selected by the code enforcer so staff could confirm continued progress before spending public funds. The motion passed by recorded vote.

What this means: Code enforcement now has the delegated authority to schedule abatement work, and the council advised staff to document future dumpster contracts more clearly so residents understand dumpster sizes and associated charges. The owner was told she may sign a new contract for larger dumpsters if she wants them returned and emptied; otherwise the city would offer the smaller containers under the residential program.

Next steps: Code enforcement will monitor progress and proceed with abatement if necessary; any abatement costs may be assessed as a lien on the property per city code.
