Commissioners approve O'Patrell 10‑acre plat despite neighbors' objections over proposed concrete plant

The Clay County Board voted to approve the final plat requested by landowner Steve O'Patrell to split a 66‑acre parcel along U.S. Highway 75 into a 10‑acre lot and a 53.73‑acre remainder. County planner Matt explained the parcel is zoned Agricultural General and that concrete ready‑mix plants are permitted as an interim use in that district. Matt told the board the planning commission authorized preparation of the final plat and that the planning commission would later hear an interim‑use permit for a concrete ready‑mix plant on Lot 1.
Applicant representative John Lowry of Lowry Engineering told the board "this is about creating the 10 acre parcel, not the proposed use." He said the interim‑use permit process is separate and must be pursued even if the plat is approved. Several residents spoke in opposition, citing noise, dust, vibration, highway safety, and groundwater and well concerns. Dan Moore said he had not received mailed notice and described prior crushing operations that raised his concern; Dale Schoefeldt and Laura Walker described truck traffic and the loss of rural character.
Commissioners debated landowner rights, comprehensive‑plan goals and the limits of the county’s authority. Planner Matt noted MnDOT reviewed access and "didn't at this time think there's a turn lane or traffic study required" based on the applicant’s submittal; he said MnDOT’s primary comment concerned shoulder paving.
After deliberation, Commissioner Bair moved to approve the O'Patrell final plat based on the planning commission recommendation; Commissioner Ebinger seconded. The board conducted a roll‑call vote and the chair announced the motion carried. The planning commission hearing on the interim‑use permit (concrete plant) was scheduled for that evening; appeals of planning commission decisions, Matt said, would go to district court or the Minnesota Court of Appeals rather than to the county board.
Next steps: the planning commission will decide the interim‑use permit for the concrete ready‑mix plant later the same evening, and residents were informed of judicial appeal routes if they contest that decision.
