The Metro short‑term rental board reversed a revocation Nov. 19 and allowed the owners of 1107 Ordway Place to continue operating the property as an owner‑occupied short‑term rental after hearing new evidence presented at the hearing.
Metro staff had urged revocation, citing assessor and trustee records, court filings and online advertisements suggesting the owners listed 1208 Delmere Drive as their address and that multiple rentable units were advertised. "The Airbnb ads were entitled East Retreat 1 and East Retreat 2," staff told the board when summarizing evidence of two separate listings.
Willie Jackson, speaking for the appellants, said the family lives at 1107 Ordway but maintains Delmere Drive as a mailing address to keep important mail secure; he offered an NES energy‑usage letter showing very low electricity usage at Delmere Drive over the prior 12 months and a series of documents (bank statements, insurance) listing Ordway as the residence. "We do live at 1107 Ordway Place," Jackson told the board.
Neighbors, including Natalie Hannigan, said they have seen frequent short‑term renters at the property and submitted a notarized statement and a returned certified letter to show mail was not being collected at Ordway. "They are in and out a 100% in and out," Hannigan said of the Jacksons' occupancy.
After extended deliberation over the assessor records, the NES usage letter and changed addresses on documents submitted after the revocation notice, the board made a discretionary determination: while it found the zoning administrator’s initial decision was not clearly erroneous given evidence available at the time, the board concluded that the newly submitted materials warranted reversing the revocation and permitting continued operation as an owner‑occupied STRP.
