Board approves rezoning and subdivision at Church & Sweeney; denies tire-shop conditional-use permit

At a public hearing the Board of Aldermen voted to rezone 7.78 acres at the southwest corner of Church Road and Sweeney Road from R-30 (low-density residential) to C-1 (neighborhood commercial). Planning Director Whitney Cook said the citys future land-use map designates the site for service/neighborhood commercial and the Planning Commission recommended approval by unanimous vote. Alderman Gallagher moved to approve the rezoning; the motion carried on roll call.
On the same site the board approved a subdivision to split the property into four lots ranging from about 1.59 to 2.27 acres, with Lot 1 described by staff as planned for an oral surgery center. Staff said the developer must provide certain improvements, and that some Sweeney Road upgrades would be at the developers expense. The Planning Commission had voted unanimously in favor of the subdivision.
Separately the board considered a conditional-use permit request to convert an existing vacant retail building at 1175 Main Street (Stateline/Main) into a tire and motor-vehicle repair shop. Whitney Cook told the aldermen staff and the Planning Commission were concerned about an existing concentration of automotive service uses nearby, storage of used tires on an asphalt island site, the locations visibility to adjacent businesses (including a Sonic), and inconsistency with the West End revitalization objectives. The planning commission recommended denial. Alderman Hoops moved to deny the permit; the board voted to deny the conditional-use permit.
The board cited compatibility with the comprehensive plan and neighborhood character in its approval of the rezoning and subdivision and the denial of the conditional-use permit. Staff will proceed with design-review steps for the approved subdivision and return to the board for any required site-plan approvals.
