Fall River planning board endorses multiple ANR lot divisions, tables one plan for corrections

At its Nov. 7, 2025 meeting, the Fall River forum and planning board reviewed and voted to endorse several approval-not-required (ANR) plans to divide or reconfigure lots across the city.
Staff summarized each file and recommended endorsement where plans conformed to area, frontage and zoning relief previously granted by the zoning board. The board approved endorsement motions for File 25-1644 (Resendiz Residential LLC, 200 Highcrest Road), File 25-1645 (Robert Oldfield, 179 Wood Street), File 25-1646 (Joanne and Joyce Samaras, 559 Ridge Street), File 25-1648 (Intel Investments LLC, 16162 Lockwood Street), File 25-1651 (De Oliveira, 271 Mount Hope Avenue), and File 25-1654 (Charles J. O'Gara, 163 Brayton Avenue). Each plan was discussed in turn; staff noted where variances or special permits applied and where deed restrictions (for example, no future accessory dwelling units) were part of the zoning conditions.
A board member raised a recurring concern about “paper” or unimproved private ways: selling lots without completed roads can leave buyers unable to build or access parcels. Planning staff explained that ANR endorsement confirms lot lines and zoning compliance for the recorded plan but that road and utility construction and any required roadway improvements are handled later at the roadway-improvement or site-plan stage. In one matter — File 25-1653 (37 Park Street Partners LLC) — board members found incorrect recorded-decision references on the plan and voted to table endorsement until the engineer resubmits corrected materials and deed/decision references.
The board also approved minutes for Sept. 10 and Oct. 8, 2025 and adjourned. The endorsed ANR plans proceed as recorded plans; any conditions tied to zoning variances or special permits remain in force and will be enforced at later permitting stages.
