At its monthly meeting, the City of Des Moines Zoning Board of Adjustment approved two sign-related zoning exceptions on the consent agenda and heard that a third application had been withdrawn, Chair Mel Pins said.
Frank Dunn, planning staff, recommended moving item 2 (a signage application for a new store at 4410 Southeast 14th Street) to the consent agenda. "Staff is recommending that item number 2, be moved to the consent agenda," Dunn said. The applicant had proposed five signs, of which two would be allowed by right; staff recommended approval of one additional sign and a maximum total sign area of up to 105.75 square feet.
The board, a seven-member volunteer panel with five members present, voted 5-0 to place item 2 on the consent agenda on a motion by board member Marlys Jones and a second from Rhonda Sadillo. After polling the room for opposition to both item 1 (a zoning exception request related to signage at the Des Moines Airport) and item 2, the board voted to approve both items on consent on a motion by Rhonda Sadillo, seconded by Marlys Jones. "So items 1 and 2, those zoning exceptions for signage have been approved," Pins said.
The meeting record notes that item 3, for the site at 3218 Southwest 9th Street, was withdrawn by the applicant and will not be heard; an applicant who withdraws must re-file with new notices to be considered at a later meeting.
Under the board's procedure, approved decisions will be documented in a decision and order. "Give us about a week, and you'll get a copy of that decision in order," Pins said; the chair also reminded applicants that approvals must be implemented within two years and that decisions may be appealed to the Iowa District Court within 30 days.
The board's action will allow the applicant at 4410 Southeast 14th Street to proceed with final signage permitting consistent with staff conditions.
