The Planning Commission voted to forward a positive recommendation to the City Council for a comprehensive rewrite of Chapter 25, Article 12, which addresses nonconforming development.
Planning staff (Speaker 1) said the revision expands the definition of "nonconforming" to include uses, lots, buildings and off‑street parking facilities, and sets the date used to determine nonconformity as Feb. 6, 2000, tied to Ordinance 36‑39. "I'm gonna put in code that the date where a nonconforming use can be determined is 02/06/2000, due to ordinance 36 39," the staff member said, explaining the intent is to preserve the existing 2000 baseline used in prior updates rather than shifting the baseline with each code change.
Staff said the rewrite aims to reduce legal ambiguity and cited examples where the change would clarify enforcement, such as mobile home parks and older commercial parcels that are built to lot lines or cannot meet modern parking calculations. The proposed Article 12 also creates standards for nonconforming off‑street parking facilities to reduce the frequency of variance requests to the board of adjustment while preserving neighbor notification and variance routes where parking causes special hazards.
A motion was made and seconded to recommend adoption of the revised Article 12; the commission approved the recommendation on roll call and will forward the draft ordinance language and findings to the City Council for consideration.
