Chair presented a letter from the Iowa State Association of Counties asking Linn County to contribute $500 toward an ISAC filing in the U.S. Supreme Court. The filing would support Shelby and Story Counties’ request for further appellate review of an Eighth Circuit panel decision that invalidated their local zoning ordinances regulating a hazardous liquid pipeline on grounds of preemption by the Federal Pipeline Safety Act.
"This is highlighting the importance of local control," the chair said while reading portions of the ISAC letter and recommending county support at the $500 level. Supervisor Sheets said he was "happy to support at that level as well." The chair and Supervisor Sheets then decided to add the $500 contribution to the consent agenda for Wednesday rather than taking an immediate vote.
No formal vote was taken at the Nov. 3 meeting; staff will place the contribution on the Wednesday consent docket for formal action.
