Sean Darling, appearing with power of attorney for Jonah Honesak LLC, requested lien mitigation for multiple commercial properties. Darling said the respondent had not been made aware of the violations earlier because the registered agent had medical issues and therefore did not receive mailed notices. He said property improvements were completed, and the business had been working toward certification and permits.
City staff reviewed the posted and certified-mail records and presented a breakdown of assessed fines. After discussion, the special master approved an 85% reduction, lowering the outstanding balance from $28,555.00 to $4,283.25 and imposing an $8 administration fee for the mitigation. The special master recorded the folio number and directed staff to provide payoff instructions and accept payment arrangements.
The record shows certified-mail evidence was examined during the mitigation hearing and that the reduction was negotiated and granted on the administrative record. The ruling does not eliminate the city's ability to enforce future code violations but resolves the historical assessed balance upon payment of the mitigated amount.
