Committee moves technical fix to child-abuse homicide statute to session

Chair opened a committee bill to correct an error from last session’s child-torture legislation that had unintentionally added the term "child torture" to the child abuse homicide provision as well as to the murder statute. Jackie Rogers, associate general counsel with the Office of Legislative Research and General Counsel, told the committee the draft simply removes the misplaced reference and places an immediate effective date so the statutory mistake is corrected as soon as the bill passes during session.

Rogers said the original child‑torture language was intended to be added only to the murder statute, not to the child abuse homicide statute, and described the change as "a very brief presentation" to fix that drafting error. Committee members characterized the correction as straightforward and moved the draft out of committee. A voice vote recorded unanimous approval.

Because the amendment is framed as a technical, retrospective correction to statutory text rather than a policy change, no appropriations or new definitions were presented during the committee hearing. The committee indicated it intends to shepherd the correction into session promptly so the statutory inconsistency will be resolved early in the lawmaking process.
