Carlos Alexander, assistant city attorney for the City of South Fulton, told the Zoning Board of Appeals on Nov. 20 that agenda item 2, an administrative appeal related to Implement Sand Town, could not proceed because statutory notice requirements for that type of appeal had not been met.

Alexander told the board and the public the item "must be deferred from tonight's agenda" so staff can correct notice and scheduling. A board member moved to defer the item and another seconded; the motion carried by voice vote and the item will be placed on the next meeting's agenda with corrected notice procedures.

The board treated the deferral as a matter of procedural compliance rather than substance; no substantive testimony or argument on the appeal was heard at this meeting. Staff said it will provide the correct code section and any needed documentation to board members ahead of the next hearing.
