The Village of Westmont on Nov. 20 approved a master license agreement that gives EZ Fiber Texas LLC one-time approval to install fiber in the village right-of-way and then permit individual buildouts through public-works permits rather than repeated board appearances.
Staff said the agreement mirrors a previously approved agreement for Lumos Fiber and aims to streamline subsequent permits. "We're using the same agreement with any other applicant that comes in," a staff representative said.
Trustees and staff discussed construction timing, coordination between multiple providers and protection for resident property restoration. An IT or public-works representative told the board providers will market to affected neighborhoods with door hangers and signage and typically complete work in sections, noting individual sections may be two to three weeks "in and out." Another staff member highlighted restoration obligations with a five-year maintenance period for landscaping and settlement. "There are some pretty strict restoration requirements ... and a 5 year maintenance period," staff said, adding the village can require replanting or other fixes if settlement occurs.
Trustees asked about bonding and enforcement. Staff said bond amounts are set by the village's construction-standards ordinance and are based on total cost of work; they emphasized the bond covers the installed improvements rather than the entire potential network. Staff also explained that, as a non-home-rule municipality, Westmont cannot impose a franchise requirement on pure telecommunications providers but may impose restoration and permitting standards.
The board approved the master license agreement by roll call; trustees requested staff continue outreach to coordinate construction schedules and public notices to lessen repeated disruptions to the same residential areas.
