Stormwater ordinance update presented; council defers action to commissioners

Chris Moore, presenting for the county stormwater department, told the council Floyd County ordinance FCO-2025-24 would update the stormwater user-fee system last revised in 2007. Moore said the ordinance had been vetted at a joint council/commissioners meeting and by the stormwater board; the commissioners adopted the ordinance at their Nov. 4 meeting. Council members were advised by attorneys that the council could either acknowledge receipt or vote in unison with the commissioners but was not required to take further action. A councilor moved that the council take no action and allow the commissioners' approval to stand; the motion carried and staff requested a written acknowledgement or a signature page documenting that the council had been informed.
The council's decision was limited to acknowledgement: the ordinance itself had already been adopted by the county commissioners, and the council did not enact or modify the ordinance during this meeting. Staff said they would accept an emailed letter or signature page from the council attorney confirming that no action was taken.
Next steps: stormwater staff will accept a written acknowledgement from council counsel and proceed under the commissioners' adopted ordinance. Council asked that consultants and staff be available to respond to any follow-up technical questions.
