The Fishers Board of Zoning Appeals on Wednesday approved Case VA-25-19, allowing a secondary dwelling unit in an accessory structure at 10714 Cynthia Road, with conditions the approval be recorded and the unit not be rented.
Chair introduced the petition and identified Scott Barnes as the petitioner. Barnes told the board he purchased the property about four months earlier and described the existing accessory structure as a garage with a second floor that "needs a lot of work." He said the main house at 10714 has a two-car garage and that he intends to reside at 10714; he did not indicate plans to add a replacement garage.
After opening the public hearing — during which no members of the public spoke — a board member moved to approve VA-25-19 provided the approval letter and related documents be recorded with the Hamilton County Recorder's Office and that the accessory dwelling unit not be rented and be limited to use by the property owner or the owner's guests. Mr. Silvey seconded the motion. The roll call recorded yes votes from Mister Grinslade, Mister Silvey, Mister Stevenson, Mister Lanham and Mister Ferrucci; the motion passed unanimously.
The board's approval carries the two explicit conditions recorded in the motion: recording the approval with the county recorder and restricting occupancy and use of the ADU to the property owner or guests, with rental prohibited. The chair wished the petitioner luck before moving to the next item.
