The Mobile Planning Commission on Nov. 20 recommended rezoning Lot 2 at 7125 Bellingrath Road from R‑1 to CW (commercial warehouse), approved a two‑lot subdivision and granted a sidewalk waiver for the proposed development.
Applicant representative Casey Pipes said the church (First Baptist Church of Theodore) is selling excess land (Lot 2) and the buyer intends a truck‑repair use; the applicant accepted staff’s suggestion to change the requested zoning from B‑4 to CW for dimensional reasons and to allow the proposed use by right under CW with accompanying voluntary use restrictions. Commissioners clarified that the rezoning approval at the commission stage includes the requirement that the associated voluntary use restrictions be revised to match CW standards before the rezoning is advertised to City Council.
During public comment, neighborhood residents asked about the difference between B‑4 and CW zoning, traffic safety and stormwater. Tangela Craig, who lives on Bellingrath Road, said she was worried about runoff reaching Mud Creek and increased heavy‑truck traffic and turning movements near a location where a recent fatality occurred. Planning staff responded that site development will require on‑site stormwater detention as part of the permitting process and that traffic impacts would be evaluated in the permit or by a traffic impact study if triggered.
Commissioners voted to approve the subdivision and sidewalk waiver and to recommend rezoning to CW, adopting the required findings of fact. The commission and staff agreed the applicant must submit revised voluntary use restrictions to reflect CW’s associated list of uses before the item advances to City Council.
What’s next: The rezoning recommendation will be advertised to City Council with the updated voluntary use restrictions; engineering and stormwater requirements will be enforced at permitting for any development on Lot 2.
