Kevin Fisher, planning and zoning staff, told the commission staff recommends amending the city's infill planned unit development (IPUD) by removing the principal use "yacht club/private marina." Fisher said Florida's 2023 "Live Local" statute preempts local public hearings for certain residential projects on commercially or industrially zoned parcels and allows applicants to pursue higher densities through administrative approvals.
"By eliminating that one use, it would be strictly a residential zoning district, which would therefore not allow future requests from developers to utilize Live Local," Fisher said. He told commissioners that IPUD remains limited to a density of 20 units per acre under current code but that Live Local could allow an applicant to use the highest allowable density citywide.
Staff noted only a few vacant IPUD parcels exist in the city. The proposed code amendment is framed as a preemptive measure to reduce the chance that a future applicant could transform the IPUD into a higher-density Live Local project by invoking the state statute.
The commission asked clarifying questions about the mechanics and intent of the amendment; staff said the change is designed to align local land-use outcomes with current council policy preferences and to avoid unintended consequences of recent state statutory changes.
