The board reviewed a combined well-setback and Title 5 variance request for a property presented by Dawn Bracken of Bracken Engineering on Nov. 20. The applicant said revised plans removed leaching catch basins and presented an exemption request for the "pill-shaped" well protection zone because the lot was created in 1872 and certain dimensional requirements could not be met.
Bracken said prior approvals and a 1993 septic approval for a four-bedroom system are on file for the parcel. John (board staff) confirmed the site is deed-restricted to a single bedroom as presented and noted the board has granted similar relief to nearby properties in the past. Board members asked questions about the certificate-of-compliance language and potential grandfathering of prior permits; engineers recommended clarifying revisions to the draft regulations to avoid unintended invalidation of existing approvals.
After discussion the board made a motion to approve the requested relief, the motion was seconded, and the board voted in favor. The board recorded the motion and instructed staff to finalize conditions consistent with the board’s decision and the record.
