Flagler County planning staff presented Project 2025080044 on Nov. 12 as a special-exception request to allow a two-story professional office building on Lot 14, Cinnamon Grove Village. Staff reported the proposed building would be about 5,000 square feet (4,875 sq ft gross leasable area), provide 41 parking spaces (39 regular, 2 ADA), and include required landscape buffers including a 40-foot buffer along North Ocean Shore Boulevard (A1A scenic corridor overlay). Staff said required utilities exist nearby and that approval would be conditioned on compliance with the A1A overlay, undergrounding new utilities, screening refuse areas, and other conditions listed in the staff report.
Dennis Clark, representing Scenic A1A, said he believed staff undercounted the gross leasable area and recalculated that the building’s two floors together equate to a much larger floor area, which would raise the minimum parking requirement; Clark said the site as proposed could overflow parking if the business is fully occupied. “The staff is submitting that it's 4,800 square feet, which is less than half the size of the 2 floors in the building,” Clark said, adding his own estimate of the needed parking.
George Duran, the owner/builder, replied that the team had been transparent in the submittal and that the applicants had provided the parking shown; Jim Davis, representing the Cinnamon Grove HOA, said the HOA reviewed the drawings and had no objection, praising the landscaping.
A board member moved to approve the special exception with the conditions read into the record and to include a timeline. After discussion the board added a condition that construction be completed within five years of approval. The motion passed unanimously.
The approval is limited to the professional-office use described and carries site-specific conditions (including conformance to the submitted conceptual site plan, required buffers and screening, undergrounding utilities where required, and obtaining any other agency approvals). The requirement to obtain any needed approvals from the Board of County Commissioners (for example, a waiver to allow compacted or nonstandard parking surfaces if later requested) remains the applicant’s responsibility.
